Income from freelancing, gig work, consulting, design, teaching and content collaboration cannot be judged for final individual income tax (IIT) simply by "income times a percentage." First determine the nature of the income, then distinguish whether it is withheld by the payer, whether it is included in the annual reconciliation of comprehensive income, and whether eligible expenses can be deducted. 1. First Determine Which Income Category It Belongs To

"Side job" is just an everyday term and does not automatically determine the tax category. One-off gigs versus continuous operation, whether you bear business risk, and contract and invoicing arrangements can all affect the determination.

2. Estimation Approach for Personal Service Income

In the common resident-individual scenario, personal service income withholding is usually calculated by first deducting a certain amount from the income, and the payer withholds prepay according to the rules; during annual reconciliation, eligible personal service income is included in comprehensive income as prescribed and combined with wages and salaries for calculation. The withholding amount and the final annual tax may differ, so the withholding amount cannot be taken directly as the annual tax payable.

Four-Step Estimation

  1. Total the year's tax-inclusive income, and retain contracts, settlement statements, and withholding vouchers by item.
  2. Confirm the nature of each payment, whether the payer has withheld, and the withholding month.
  3. Estimate the income amount includable in comprehensive income, then subtract the basic deduction, special deductions, and eligible additional special deductions.
  4. Estimate the tax payable using the annual comprehensive income tax rate table, compare it with the prepaid tax, and obtain the possible refund-or-top-up difference.

3. Case: Two Side Design-Income Payments During the Year

Xiao Lin received two design-service payments during the year, and the payers respectively issued withholding records. When estimating, first verify whether both payments are personal service income and whether there is any duplication or omission, then merge the relevant comprehensive income on the annual-reconciliation basis. If there is also wage income during the year, wages and eligible personal service income may jointly affect the annual tax bracket; the final result is also affected by the three insurances and one fund, additional special deductions, and other lawful deductions, so a definitive tax amount cannot be given based solely on the two payments.

4. Do Not Apply the Personal Service Formula to Business Income

If the activity has characteristics such as continuous operation, matched revenue and costs, and business as the main mode, it may need to be handled from the business-income perspective. Business income generally concerns revenue, costs and expenses, losses, and the business-entity situation, and its filing cycle may also differ from comprehensive income. Freelancers should retain authentic vouchers for purchases, platform service fees, office expenses, and outsourcing, but whether they are deductible, the deduction ratio, and the filing method must be confirmed according to the applicable rules.
